This explainer is only about the word "competent," which has two meanings worth separating. « Compétent » ne veut pas dire la même chose en droit et dans le langage courant. Attendre « la juridiction compétente » est une raison valable de ne pas déclarer une culpabilité ; c'en est une plus faible pour tenir pour inconnus des faits déjà établis en dehors du procès. Et là où l'indépendance de la justice est contestée, s'en remettre au seul verdict à venir n'est pas neutre. "Competent" doesn't mean the same thing in law and in everyday speech. Waiting for "the competent court" is a valid reason not to declare guilt; it's a weaker one for treating as unknown facts already established outside the trial. « Compétent » = qui a compétence, c.-à-d. la juridiction. C'est le tribunal légalement habilité à connaître d'une affaire donnée (par la matière, le lieu, le degré). Cela ne dit rien sur sa qualité ni son indépendance — seulement qu'il a le droit de juger ce dossier-là. "Competent" = having competence, i.e. jurisdiction. The court legally entitled to hear a given case (by subject, place, level). This says nothing about its quality or independence — only that it has the authority to rule on that file. « Compétent » = ifise ububasha (juridiction). « Compétent » = capable, fiable, qui fait bien son travail. Dans l'usage quotidien, dire « la juridiction compétente tranchera » évoque implicitement un juge fiable et impartial. Cette nuance rassurante s'ajoute, souvent sans qu'on le remarque, au simple sens juridique. "Competent" = capable, reliable, does its job well. In everyday use, "the competent court will decide" implicitly evokes a reliable, impartial judge. That reassuring shade attaches — often unnoticed — to the plain legal sense. « Compétent » = ushoboye, wizigirwa, akora neza. Le glissement est là : s'en remettre à « la juridiction compétente pour établir la vérité » emprunte la force du sens courant (un juge fiable) tout en n'invoquant, en droit, que le sens juridique (un juge habilité). Or, au Burundi, l'indépendance de la magistrature est justement l'objet de critiques documentées et convergentes. Le rappeler n'est pas préjuger d'un dossier : c'est situer ce que « le verdict de la juridiction compétente » peut, ou non, garantir. The slippage is there: deferring to "the competent court to establish the truth" borrows the force of the everyday sense (a reliable judge) while, in law, invoking only the legal sense (an authorised judge). Yet in Burundi, judicial independence is precisely the object of documented, converging criticism. Noting this doesn't pre-judge any file: it situates what "the competent court's verdict" can, or cannot, guarantee.
